The agreement
These Terms of Service (the “Terms”) form a binding agreement between you and Artemius Labs LLC, 1021 E Lincolnway #10375, Cheyenne, WY 82001, United States, the company that operates Comix (“Comix”, “we”, “us”), governing your use of mycomicstory.com, the Comix web application, and every related service, export, and printed product (together, the “Service”).
By creating an account, generating a comic, subscribing to a plan, or placing a print order, you accept these Terms in full. If you do not accept them, do not use the Service.
Two further documents form part of this agreement and are incorporated by reference: the Privacy Policy and the Refund Policy. Where the Refund Policy addresses payments, cancellations, or returns, it controls over any general statement in these Terms.
Who may use Comix
The Service is built for adults making books for the children in their care. To use it you must:
- be at least 18 years old and legally able to enter into a contract;
- be the parent or legal guardian of every child who appears in a book you create, or have the permission of that child’s parent or legal guardian, and confirm this by ticking the consent box before the child’s photo is used (we store the time of that confirmation with the book);
- hold the rights to every photograph you upload, including the right to have it processed to generate illustrated artwork;
- not be barred from using the Service under any applicable law or sanctions regime.
Comix is not directed at children and children may not create accounts. Accounts are personal; you are responsible for everything that happens under yours, including the acts of anyone you give access to.
Accounts and security
You may register with an email address and password, or sign in with Google. You agree to give accurate registration details and to keep them current. Keep your credentials confidential and tell us at support@mycomicstory.com as soon as you suspect unauthorised access.
We may suspend or close an account that is used to break these Terms, that presents a security or fraud risk, or that has been inactive for more than twenty-four (24) months. Where we can do so lawfully and safely, we will give you notice and a reasonable chance to download your books as PDFs first.
What the Service does
Comix takes a photograph and a chosen occasion and uses automated systems, including third-party generative AI models, to write and illustrate a personalised comic book. Books are private to your account by default. You can read your book and download it as a PDF and, on eligible plans, edit any page, create a share link, and order a printed copy.
Stories are written under rules that require gentle, age-appropriate content, but AI output can occasionally be imperfect. You can delete a book at any time or, on the Family plan and above, edit any page, and you can report a problem to support@mycomicstory.com.
Generated output is probabilistic
Automated generation is not deterministic. Two runs from the same photo and the same occasion will produce different art and different text. Likeness is an artistic interpretation, not a portrait: features, hair, skin tone, clothing, and proportions may differ from the source photo, and some pages may need an edit.
Variation of this kind is an inherent characteristic of the Service and how it is described here — it is not a defect, and it is not a ground for a refund under the Refund Policy.
We may add, change, or remove features, themes, styles, and model providers at any time. If we remove a feature that is material to a paid plan you already hold, you may cancel the plan for the future; cancellation is governed by the Refund Policy.
Your content and the books you make
Your uploads stay yours. Photographs, names, prompts, and edits you supply (“Your Content”) remain your property. You grant Comix a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, and process Your Content strictly to operate the Service for you: to generate and re-generate your book, to render previews and exports, to fulfil a print order, and to keep backups.
That licence lasts as long as you keep the relevant book, and ends when you delete it, subject to the backup and retention periods set out in the Privacy Policy.
Your books are private. Only you, signed in to your account, can open a book. On the Family plan and above you can create a share link that lets anyone who has it read the finished comic — not the original photo, the child’s age, or their interests — and you can turn that link off at any time, which stops it working immediately.
We do not use Your Content to train models. Under OpenAI’s API data policy, data we send through its API is not used to train its models either. We do not sell Your Content, and we do not license it to advertisers or data brokers.
The finished book is yours to use. Subject to your account being in good standing and your plan being paid up, we assign to you such rights as we hold in the comic generated for you, and you may read, share, print, and gift it for personal, non-commercial purposes. Commercial resale, redistribution as stock artwork, or use of the output to train another model requires our written permission.
What we cannot promise about generated art
Generative models can produce output that resembles existing work, and the copyright status of AI-generated material is unsettled in many countries. We therefore make no warranty that a generated comic is protectable by copyright, or that it is free of any third-party claim.
Acceptable use
You agree not to use the Service to:
- upload a photograph of a person whose guardian has not consented;
- create sexual, violent, hateful, degrading, or otherwise harmful depictions of any person, and above all of any child;
- impersonate a real person, or fabricate material intended to deceive;
- infringe anyone’s copyright, trademark, privacy, or publicity rights;
- probe, scrape, reverse engineer, rate-limit-evade, or resell the Service or its underlying models;
- share, sell, or rotate accounts to exceed plan limits, or create multiple accounts to repeat a free allowance or a refund;
- upload malware, or interfere with the integrity or performance of the Service.
Free-text inputs are length-limited and checked by automated moderation before a story is written, and requests flagged as unsafe are refused. Moderation is automated and nobody reviews your content by hand, so if a comic contains something that should not be there, please report it to support@mycomicstory.com. We may refuse a generation, remove content, and suspend or terminate an account that breaches this section, without refund and without prior notice where the breach is serious. Material involving the sexual exploitation of children is reported to the competent authorities.
Plans, billing, and renewal
Paid plans are sold as recurring subscriptions in US dollars, billed monthly or annually in advance, at the prices shown on the pricing page at the time of purchase.

- Keepsake
- Everything in Family, twelve comics a month, and the ability to order printed books.
- Studio
- Everything in Keepsake, thirty comics a month.
Free accounts. An account without a plan may create one comic in total, which it can read and download. Editing, sharing links and ordering printed books require a plan.
Monthly allowances. Each plan includes a set number of comics per billing period. The allowance resets at the start of each billing period and unused comics do not carry over. Generating a comic uses one of the allowance whether or not you keep it.
Automatic renewal. Every subscription renews automatically at the end of each billing period, at the then-current price for your plan, until you cancel. You authorise us and our payment processor to charge your payment method on each renewal date.
Cancelling. You may cancel at any time in Settings → Manage billing, which opens Stripe’s billing portal. Cancelling stops the next renewal; your plan stays active until the end of the period you have already paid for, and there is no partial or prorated refund for that period. The treatment of amounts already charged is set out in the Refund Policy.
Price changes. We may change plan prices with at least thirty (30) days’ notice by email. The new price applies from your next renewal. Continuing to use the plan after that date is acceptance of the new price.
Failed payments. If a charge fails we may retry it, suspend paid features, and after fourteen (14) days downgrade the account. Taxes are your responsibility where they are not collected at checkout. Billing questions go to support@mycomicstory.com.
Printed keepsakes
Printed books are made to order from your own book file by third-party print partners. Each printed item is custom-made and personalised to your specification and is manufactured only after you place the order.
Print prices, formats, and lead times are quoted at the point of order and are estimates. Delivery dates are not guaranteed, and risk of loss passes on hand-over to the carrier. Customs duties and import taxes are payable by the recipient.
Because printed keepsakes are personalised goods produced to your order, they are excluded from ordinary return and withdrawal rights. Defect handling is set out in full in the Refund Policy.
Third-party services
The Service depends on providers we do not control: Supabase (database, authentication, and file storage), Vercel (hosting), OpenAI (story writing, illustration, and moderation), Stripe (payments and billing portal), Google (optional sign-in), Cloudflare (bot protection on sign-up), Meta Platforms (advertising measurement), and print and delivery partners. Their availability, policies, and prices can change, and outages on their side will affect the Service.
We choose providers with care and bind them contractually to protect your data, but we are not responsible for their independent acts or omissions beyond what these Terms and the Privacy Policy require of us.
Availability and changes
The Service is provided on an “as is” and “as available” basis. We do not commit to any uptime figure, to uninterrupted generation, or to the continued availability of any particular model, style, theme, or print format.
We may perform maintenance, impose fair-use limits on generation volume, and queue or throttle requests to keep the Service stable for everyone.
We may discontinue the Service as a whole on ninety (90) days’ notice, during which you will be able to download your books as PDFs.
Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.
We do not warrant that generated stories or illustrations will meet your expectations, resemble the uploaded photograph to any given degree, be free of errors, be suitable for any particular child, or be printable to any specific colour standard.
Limitation of liability
To the fullest extent permitted by law, Comix is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits, lost goodwill, or lost or corrupted data, whatever the theory of liability.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you actually paid to Comix in the three (3) months immediately before the event giving rise to the claim, and (b) fifty US dollars (US$50).
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or for any non-excludable consumer guarantee under the law of your country of residence.
Indemnity
You will indemnify and hold harmless Comix, its officers, employees, and suppliers against any claim, loss, or expense (including reasonable legal fees) arising from Your Content, from your use of the Service, from your breach of these Terms, or from a claim that a photograph you uploaded was used without the necessary consent.
Suspension and termination
You may stop using the Service at any time and delete your account in Settings → Delete my account and all photos. That permanently deletes your account, every book, photo, and illustration, the print order records we hold, and your profile, and cancels any active subscription immediately; the current billing period is not refunded, as set out in the Refund Policy. We may suspend or terminate access for breach of these Terms, for suspected fraud or payment abuse, for chargeback activity, or where required by law.
On termination your right to use the Service ends immediately. Sections on content licences, warranties, liability, indemnity, and disputes survive. Amounts already charged are handled under the Refund Policy, and termination for breach does not create a refund entitlement.
Governing law and disputes
Before starting any formal proceedings, you agree to contact us at support@mycomicstory.com with a written description of the dispute and to allow sixty (60) days for a good-faith resolution.
These Terms are governed by the laws of the State of Wyoming, United States, and the courts located in Wyoming have non-exclusive jurisdiction. If you are a consumer, you keep the benefit of any mandatory protections and any right to bring proceedings in the courts of your own country of residence.
Changes to these Terms
We may update these Terms as the Service develops. The version line at the end of this page always identifies the current version.
- 1For material changes we give at least thirty (30) days' notice by email or in-app before they take effect.
- 2For clarifications, typographical corrections, and changes required by law, the updated Terms take effect on publication.
- 3If you do not accept a change, your remedy is to stop using the Service and cancel before the change takes effect.
General
These Terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between you and Comix on their subject matter. If a provision is held unenforceable, the rest remains in force.
Our failure to enforce a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition, or sale of assets.
